Pregnancy Discrimination


Pregnancy discrimination involves treating a woman (an applicant or employee) unfavorably because of pregnancy, childbirth, or a medical condition related to pregnancy or childbirth.

An employer might engage in pregnancy discrimination by:

  • Not hiring a female applicant because she is pregnant
  • Firing or laying off a female employee because she is pregnant
  • Turning down a female employee for a promotion because she is pregnant
  • Not giving a female employee benefits for pregnancy because she isn’t married

Despite the fact that pregnancy discrimination is illegal under Federal and California law, thousands of women who are pregnant or new mothers file pregnancy discrimination charges every year.
